No, the reason is they've created a trademark called Made From Scratch. It's a name, not a descriptor.

Well, legally speaking - no. But then again, what fast food chain ever fully discloses their methods?
On the other hand...if this is the only thing troubling you, you are really lucky...lol

Although I searched for awhile in the Code of Federal Regulations, and didn't find the right one, I have seen this question before while in school and happened on the regulation that handles this. To actually settle the question Hardee's wouldn't be allowed to use the term if it wasn't allowed, period. All the other chains would be all over them for using a term that wasn't allowed

I worked at Hardee's too and the biscuits were made from a biscuit mix but it is Hardee's own recipe produced just for them. They do add the other ingredients and bake them fresh every day so I guess they can say they're from scratch because the recipe is only theirs and they're made fresh every day.

I have a recipe for a biscuit mix. It makes about 12 cups of 'mix' that I can store away in an air tight container. When I'm ready for biscuits I just add buttermilk and sometimes an egg. They are definitely home-made even though I use a 'mix'.
